The first charter school in Gloucester will open as scheduled next month after Essex Superior Court Judge Richard Welch denied an injunction brought by 15 Gloucester parents that would have prevented the school from opening.
The Judge also dismissed a lawsuit brought by the CIty against the Community Arts Charter School. However, the Judge did not dismiss a similar suit brought by the parents in which they argue that the school was given a charter illegally and that it would divert about $2.5 million in state aid from other schools in the city, an impact that will cause the district significant financial distress beginning in the 2011-2012 year.
